Myspace License Terms and Conditions

As we have already reported to you our community has concerns about the re-launched Myspace service. AIM, our UK colleagues, have highlighted concerns about the rights and conditions being requested by Myspace. Every one of our A2IM members have their own business plans for promotion and monetization and should always do what is in the best interests of their individual business’. That said please be aware of these terms and conditions MySpace is requiring before entering into a transaction with Myspace as follows:

“Clause 6. Proprietary Rights in Content on MySpace
6.    Proprietary Rights in Content on MySpace

6.1.     Myspace does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, “Content”) that you transmit, submit, display or publish (“post”) on, through or in connection with the Myspace Services. After posting your Content on, through or in connection with the Myspace Services, you continue to retain any such rights that you may have in your Content, subject to the limited license herein. By posting any Content on, through or in connection with the Myspace Services, you hereby grant to Myspace a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content solely on, through or in connection with the Myspace Services, including, without limitation, through the Myspace Services to applications, widgets, websites or mobile, desktop or other services which are linked with your Myspace account (collectively, “Linked Services”), including, without limitation, distributing part or all of the Myspace Services and any Content included therein, in any media formats and through any media channels, except that Content marked “private” will not be distributed by Myspace outside the Myspace Services and Linked Services. This limited license does not grant Myspace the right to sell or otherwise distribute your Content outside of the Myspace Services or Linked Services. After you remove your Content from the Myspace Services we will cease distribution as soon as practicable, and at such time when distribution ceases, the license will terminate. If after we have distributed your Content outside of the Myspace Services, you change the Content’s privacy setting to “private,” we will cease distribution of such “private” Content outside of the Myspace Services as soon as practicable after you make the change. Notwithstanding the foregoing, you understand and agree that once Content is distributed to a Linked Service or incorporated into other aspects of the Myspace Services, Myspace is under no obligation to delete or ask other Users or a Linked Service to delete that Content, and therefore it may continue to appear and be used indefinitely.

6.2.     The license you grant to Myspace is non-exclusive (meaning you are free to license your Content to anyone else in addition to Myspace), fully-paid and royalty-free (meaning that Myspace is not required to pay you or anyone else deriving rights from you for the use on the Myspace Services of the Content that you post), sublicensable (so that Myspace is able to use its affiliates, subcontractors and other partners such as Internet content delivery networks and wireless carriers to provide the Myspace Services), and worldwide (because the Internet and the Myspace Services are global in reach).

Myspace Music Re-launch + Related Press

A2IM’s mission has always been to create a level playing field for both the independent music label community and for the service providers who help our members promote and monetize our music. Services like iheart radio, Pandora, SomaFM and Sirius/XM and on-demand streaming services like Rdio, Slacker, Spotify, Xbox, YouTube, etc. give access for independent music discovery while also allowing independent labels and our artists to monetize their fans preferred music listening experience.

A2IM will never support those services that have licensing practices that place our associate member service providers who support our community at a competitive economic disadvantage.

A number of A2IM’s members do not have current licenses with Myspace but are finding their music up on the recently re-launched Myspace service and Myspace has suggested that this content, including recent releases, is on the website as a result of user uploaded content and have requested our members send takedown notices to delete the content. The use of user uploaded content, as opposed to creator uploaded content, has always been an area of concern for A2IM members in terms of both copyright protection and in terms of creating an unlevel playing field for those A2IM associate member music services who do compensate our label members and their artists. As a result user uploaded services have not been admitted as A2IM associate members without first showing a sufficient process to keep up only licensed content and an ability for our label members and their artists to monetize that music.

All of our A2IM members of course should and must act individually in accord with their individual best business interests and we encourage each music label to determine for themselves their own promotional and commerce plans and to make the best business decision for their individual business. While we respect our member’s individual entrepreneurial spirit our A2IM associate membership qualifications need to be in accord with the overall A2IM mission statement and at the current time A2IM’s board has voted to not renew Myspace’s membership. We welcome Myspace to appeal this decision and look forward to a time where they can meet our mission goals and be readmitted as A2IM associate members.

On Monday, Oct 15th, 2012, A2IM hosted our annual Pre-CMJ Kick-Off Event in NYC. Over 200 members braved the rain and joined in the fun. Networking and conversation among A2IM members was interwove with Slate’s offerings of pool and ping pong tables.  Thanks all who were able to join us! Associate Member Spotlight: Myspace Music

SXSW4JAPAN Benefit Album Available, Re-Stream of Live Performances Today

As we first reported to you during SXSW, A2IM member 3CG Records and recording artists Hanson worked with SXSW organizers to create a grassroots live performance music event to raise money for the victims of the earthquake and tsunami in Japan.  Already having raised over $100,000, SXSW4JAPAN efforts continue.

Today, April 5th marks the release date of the benefit album including rare & intimate performances from Ben Folds, Michael Stipe, The Boxer Rebellion, Ozomatli, Bowling For Soup, The Parlotones, The Gay Blades, Hanson, and many others.  The album is available at Amazon HERE.

Also today, there will be a re-broadcast of the live event featuring 40 artists performing more than 60 songs.  The live performances will be re-streamed in partnership with AOL and MySpace beginning at 1pm EST.
