Intellectual Property Rights Seminar for Exporters

The Fashion Institute of Technology Department of International Trade and Marketing, the Department of Commerce’s Office of Intellectual Property Rights, the U.S. Patent and Trademark Office, the U.S. Commercial Service, and the New York District Export Council, cordially invite you to attend the STOPfakes.gov Road Show, an Intellectual Property Rights Enforcement Outreach Program. This is an opportunity to learn the basics of intellectual property rights (IPR) protection and about the U.S. government resources available to help small- and medium-sized enterprises (SMEs) protect their IPR at home and abroad. This three-hour program will feature presentations by intellectual property experts and law enforcement officials, followed by an open discussion with experts from industry and government.

Seminar topics will include:

  • What is intellectual property?
  • Understanding the basics of obtaining Intellectual property rights in the U.S./resources
  • Understanding the basics of obtaining intellectual property rights in other countries/resources
  • How to enforce your intellectual property rights in the U.S./resources
  • How to enforce your intellectual property rights overseas/resources

This program is brought to you under the National Export Initiative and is co-organized by the U.S. Department of Commerce’s Office of Intellectual Property Rights, the U.S. Patent and Trademark Office, and the National IPR Coordination Center.

Recap/Video: China/IP Webinar “Judicial Interpretation on Secondary Liability on the Internet”

Topic: Judicial Interpretation on Secondary Liability on the Internet

On April 11, 2012, China’s Supreme People’s Court issued a draft judicial interpretation (JI) entitled, Regulations Concerning the Applicability of Laws in the Adjudication of Civil Disputes Related to Infringement of Rights of Transmission over Information Network, for comments.  The draft JI states that when ISPs abet and assist network users to infringe the rights of others over an information network, they shall be held joint and severally liable.  When they “know or should have known” that their network’s users are infringing,  the ISPs have committed contributory infringement.  Please join us as Sharon Qiao, partner at Lusheng Law Firm in Beijing, discusses the JI and what it may mean for the music industry.

Intellectual Property-Intensive Industries Contribute $5 Trillion, 40 Million Jobs to US Economy

On April 11, 2012, The Obama Administration released a long awaited, first-of-its kind report estimating the economic impact of IP related industries on the U.S. economy.  The study, entitled “Intellectual Property and the U.S. Economy: Industries in Focus,” was prepared by the Economics and Statistics Administration and the U.S. Patent and Trademark Office.

Protecting Intellectual Property Rights (IPR) is a priority for A2IM.  As A2IM has previously reported, In July, 2011, A2IM joined forces with other music community creator colleagues and announced our participation in the Copyright Alert Program. The Copyright Alert Program unites the music, film and television communities with the Internet Service Providers to fight content theft and to educate consumers about content theft via the ISP services that individual consumers use.  Upon announcing A2IM’s support of the program, Rich Bengloff, (A2IM President) noted that the Copyright Alert Program is an “historic agreement that will reduce the financial distress being experienced by our independent music label community so that our members and their artists can continue to create and invest in the music they love and, in doing so, help protect thousands of music artists and their musical compositions, across the United States.”

As A2IM continues to work protecting Intellectual Property Rights, we applaud the Obama Administration for continuing to do so too.

Billboard on A2IM on USTR filing

Billboard reported on A2IM’s U.S. Trade Representative filing fairly noting the A2IM perspective that “we honestly feel there is no other industry that has embraced new forms of economic and delivery models as completely as the music industry. Our members also, on their own terms, give away free content to reward existing fans and cultivate new fans of their label’s artists,” but at the same time the Billboard article notes that “Big Music gets the attention because it often takes the lead in piracy issues — because it has the most resources. Smaller companies don’t have the same resources. They may differ on the finer points of addressing piracy, but they’re firmly in the fight. As A2IM put it, piracy is not ‘a fight between Silicon Valley technology and the unfortunately shrinking Big Media Content industry,’ but rather ‘a fight for (small- and medium-sized music enterprises) that want to create intellectual property artistry that creates cultural diversity, innovation, jobs and exports.’”
