Music Community Letter To Google: Seeking A Distinction Between Legal & Illegal Content

In a letter dated August 18 to Google’s chairman, A2IM joined our fellow music creator community members commending Google and Verizon for spurring dialog about the important issue of maintaining an open Internet, but stated clearly our hope that we can look forward to their support for greater distinction between lawful and unlawful content in future conversations with the FCC, congress and other stakeholders. The letter underscores the value that music brings as a driver for broadband adoption and related applications and articulates that current legal and regulatory efforts are not working for our community as our businesses are being undermined, as are the hopes and dreams of artists. Verizon-Google: A Point-By-Point Analysis by Future of Music Coalition.

Our friends at the Future of Music Coalition have written a point-by-point analysis of the Verizon-Google proposal that we think A2IM members might find informative.

On Monday, August 9, 2010, Verizon and Google released a joint proposal for a legislative framework for broadband internet service. Although the proposal has no legal effect on its own, it is important to understand because it could serve as a model for future legislation or FCC rulemaking. We weighed in yesterday via a short media statement, which you can read here.

Over the past 24 hours, we realized there was a need to go through the proposal point-by-point and examine how the agreement might impact independent musicians and other creators, were it to be adopted as public policy.

A2IM comments on FCC Media Ownership Rules

The Federal Communications Commission (“FCC”) is doing its 2010 quadrennial review of media ownership which asks what questions the FCC should be asking related to competition, localism and diversity. Based upon the comments of the National Association of Broadcasters (“NAB”) which propose further media/radio market consolidation A2IM has filed a reply with the FCC. The A2IM reply notes that achieving radio access at traditional terrestrial AM/FM radio has always been an issue for A2IM’s members and their artists in terms of getting radio airplay and how further radio ownership consolidation could affect our community. A2IM Statement & Filing With The FCC On Net Neutrality

Perhaps the biggest issue facing the music industry is Net Neutrality.

A2IM has been surveying our members to bring our position into focus and yesterday we filed a statement with the FCC supporting Net Neutrality. Our statement highlights the unique economic needs of the independent music community and the need to balance access versus the need to eliminate illegal acquisition of music.

Net Neutrality Update: FCC Chairman Supports Net Neutrality

Net Neutrality Update: The new FCC Commissioner, Julius Genachowski issued a statement this week supporting a “free and open internet” and advocating that Net Neutrality be upheld. A2IM applauded the FCC Commissioner’s original statement and was even more encouraged a couple of days later when the commissioner added to his earlier comments by stating, “It is vital that illegal conduct be curtailed on the Internet. As I said in my Senate confirmation hearing, open Internet principles apply only to lawful content, services and applications-not to activities like unlawful distribution of copyrighted works, which has serious economic consequences. The enforcement of copyright and other laws and the obligations of network openness can and must co-exist.” Commissioner Genachowski’s full speech can be read here. (more…)
