A2IM Announces Board of Directors

Election Results

A2IM, the American Association of Independent Music, has announced the results of their 2009 Board of Directors elections as voted by the A2IM label membership.  The newly-elected A2IM Board members are below (listed alphabetically):

*Glen Barros (President, Concord Music Group)
*Jim Cooperman (COO, Wind-up Records)
*Portia Sabin (President, Kill Rock Stars)

Barros continues on the A2IM board having been re-elected, while the other members are beginning their first term. The new board’s term will begin on July 4th.

The remainder of the organization’s board (all in the midst of three year terms) are:  The Beggars Group CEO Lesley Bleakley; Razor & Tie Executive Vice President Dan Hoffman; Alligator Records Founder & President Bruce Iglauer; Roadrunner Records Executive Vice President Douglas Keogh; Bar/None owner Glenn Morrow; Lookout Records co-owner Molly Neuman.

A2IM would like to thank its outgoing board members Tom Silverman and Amaechi Uzoigwe for their time, energy, dedication, and support of A2IM and look forward to their ongoing contributions. Both leave their posts due to by-law term limits.

Alert: Collect Your Publishing Royalties & Performance Copyrights

The purpose of this e-mail is to call to your attention four things we feel every label needs to follow-up on now:

Streaming Royalties:

Don’t lose streaming royalties your label or your artists are entitled to.

As reported in A2IM Newsletter #24, the Copyright Royalty Board (”CRB”) announced new publishing mechanical royalty rates which included royalty rates for the interactive streaming of music by monthly fee paid subscription services like Rhapsody and Napster and social networking sites like Imeem and LaLa.  The first payment period will cover a retroactive period covering seven years.  Many of these services have begun or are about to begin making these payments and unless you take action you may not receive monies due to you.

Some of these services do not have the publishing information specifying who has the license for the tracks they are streaming or, in some cases, they do not have the infrastructure to pay these amounts directly to each publisher or to each holder of a copyright. Over the past seven years some of these funds were paid by the streaming services into escrow accounts being held by the Harry Fox Agency.  As a result any unclaimed funds could end up with mechanical licensing, collection, and distribution agencies that may have no rights to these funds.  In these instances, it’s quite possible that these funds could be distributed in an allocation to their publisher members who have no rights to these compositions without you or your artists ever knowing that you lost out on income. To prevent this from happening to any royalties your label controls or that should be paid directly to your artists we suggest you contact these services that do interactive streaming ASAP as many of these funds are in the process of being paid out.

A2IM Annual Meeting (NYC – Monday, June 29, 2009)

The A2IM 4th annual meeting & anniversary celebration will take place on Monday, June 29th in New York City (location tbd).

The business meeting will take place from 4pm to 6pm with the cocktail reception to follow from 6pm to 9pm.

This event is open to all independent music labels and A2IM associate members.

The A2IM annual meeting/cocktail party typically draws 200-250 members of the American independent music community.  Attendees listen, learn, voice opinions, give feedback and network with the best and brightest our industry has to offer. (more…)

Should You Waive Your Statutory Royalties?

I was at the Billboard Money and Music Conference earlier this year and there was a panel on “Investing in Online Music Start-Ups’. The moderator asked how streaming services are able to get their business models to work given the high streaming royalty costs. A panelist said the way he makes his model work is he uses indie music for 50% of his playlist and that he pays indie artists and labels less via direct licenses which enables him to dollar average to keep his royalty costs down. Remember this the next time someone asks your label or artists to waive or take a reduced royalty rate. These type of services want to grow their business models off your repertoire. Very nice! Indies Rising

Indie labels are on the rise, and the proof is in the numbers

Though the news may be filled with stories of the challenges facing the music business, perhaps the biggest untold story is that independent labels are currently experiencing some of their greatest successes in recent history. They’re hitting new market share high marks, especially in the digital realm; are increasingly being sought out by the consumer on the wealth of new platforms for hearing music, including webcasting, satellite radio, and downloads; and are breaking records for awards and accolades including a very successful year at the 2009 Grammy’s.

The take-away is clear: when music consumers are presented with real choice, indies rise. And the proof is in the numbers, with increased market share for indie labels now reaching almost a third of all music sales.

DID YOU KNOW THAT. . .

* Independent labels accounted for 32% of aggregate album sales in 2008, up almost 1.5% from 2007.

* Independent artists won 56 awards at this year’s Grammys, up from 36 last year. That marks over 50% of all prizes given out.

* Independent labels, as a group, are the largest owners of master recordings in the industry – over 80% of America’s music is under independent ownership. These labels aren’t just diverse in genre, but in size and business model, ranging from single-artist-owned labels to imprints with decades of history and catalog.  What makes a label “an indie” is that its master recordings are not owned by one of the major labels.

* That overwhelming majority of master recordings is testament to the diversity of genres covered by independent labels. The result is remarkable music that crosses boundaries, and may account for why indies notched the best album Grammy in an incredible 24 different genres in 2009.

*On top internet broadcasting platforms, where consumer choice reigns, indies thrive. Overall, independent music makes up approximately 40% of all music played at non-traditional web radio and at industry leading webcaster Pandora, over half of the music users play is independent.

*Consumer choice reigns at digital retailers as well, and the numbers reflect it, with indie market share at digital rising to 38%. Retailers are on board as well, in fact two-thirds of A2IM members have direct deals with iTunes, the industry-leading music retailer.

* In short — when traditional gatekeepers and obstacles to reaching fans are removed, indies thrive.
